    Why Most Title Companies Kill Creative Deals

    You've finally locked up a great creative deal. The seller is on board, the numbers make sense, and you're ready to close. But then, you send the contract to a traditional title company, and the deal falls apart.

    Why? Because most title companies are built for conventional transactions. When they see a subject-to or a wrap, they panic.

    The Problem with Traditional Title Companies

    Traditional escrow officers are trained to look for standard conventional loans, FHA, or cash deals. When you introduce a transaction where the existing mortgage stays in place, their immediate reaction is often to tell the seller it's illegal or highly risky, killing your deal before it even begins.

    • They don't understand the Due on Sale clause and will often misinform the seller about the immediate risks.
    • They don't have the necessary CYA (Cover Your Assets) documents and disclosures required for creative finance.
    • They struggle with setting up third-party servicing and handling insurance transfers correctly.

    How to Find an Investor-Friendly Title Company

    You need a title company that regularly handles creative finance. Here are a few questions you should ask when vetting a new title company:

    • "How many subject-to or wrap transactions have you closed in the last 6 months?"
    • "Do you have your own subject-to disclosures, or do I need to provide them?"
    • "Are you comfortable working with third-party servicing companies?"

    What to Prepare Before Sending the Contract

    Even with an investor-friendly title company, you need to be organized. Bring a complete package to the table:

    • The executed purchase agreement clearly stating the terms of the creative finance structure.
    • A preliminary HUD/settlement breakdown showing how arrears and closing costs will be handled.
    • Contact information for your selected third-party servicing company.
